Terms of Service
The terms for using runapx.com.
Last updated ·
These terms are an agreement between you and Alpha Peak Technologies LLC, doing business as APEX Training Group (“APEX,” “we,” “us”). They cover the website at runapx.com and the member portal families use once they join (together, the “service”). By using the service, you agree to them. If you don’t agree, please don’t use it.
Joining APEX also involves the documents you accept in the portal: the membership waiver, and the renewal terms shown before you pay. Those govern training with APEX and billing. If one of them conflicts with these terms, that document applies.
Who can use the service
- Anyone can browse the website and send us a request or a message.
- Portal accounts are for families APEX has invited. For an athlete under 18, a parent or guardian creates and manages the account, accepts our documents and pays, and agrees to these terms for the athlete.
- Athletes under 13 don’t have their own login. An athlete aged 13 to 17 may have one, managed by their parent or guardian.
Your account
Give us accurate information and keep it up to date. Keep your sign-in to yourself, whether you use a password or “Continue with Google,” and tell us right away if you think someone else has used your account. You’re responsible for what happens under your account. Give other family members access through the portal rather than sharing your sign-in.
Memberships and payments
Memberships, and anything you buy in the portal’s Shop (a camp, a clinic, kit), are paid through Stripe. Before you pay, the portal shows the price, how renewal works, how to pause or cancel and our refund terms, and you agree to them. In short: a membership renews automatically until you pause or cancel it in the portal (open Membership and choose the athlete), and access continues to the end of the period already paid for. A paused membership stays paused until you resume it, and you’re charged on the day you resume. A cancelled membership ends then; to come back after that, ask APEX. While a membership is paused or cancelled, you can still sign in to see your billing, documents and account. To ask for a refund you email support@runapx.com. If a payment is overdue when you pause or cancel, it takes effect at once instead. The terms you agreed to at checkout are the ones that apply.
A parent or guardian can also delete an athlete’s profile, at the end of the athlete’s Profile in the portal, once nothing renews. That deletes the athlete’s details right away, as our privacy policy describes; a pause or cancellation already set still ends on its date, and nothing more is charged. Signed documents and billing records are kept.
We may change prices. We’ll tell you by email before a change applies to your membership.
Training and health
APEX coaches distance running. What we share on the website, in the portal or in a training plan is coaching, not medical advice. Check with a doctor before starting or changing training, and tell us about anything that could affect an athlete’s safety. Taking part in APEX training is covered by the membership waiver.
Using the service fairly
Please don’t:
- try to see or change another family’s account or records, or get around how the portal controls access;
- send false information, impersonate someone, or use our forms to send unwanted messages;
- upload anything unlawful, harmful or that you don’t have the right to share;
- interfere with the service, test its security without our written permission, or overload it;
- copy the service or its content in bulk with automated tools;
- use the service in a way that breaks the law.
What you share with us
You keep ownership of what you send or upload, such as forms, messages, documents and training data. You let us store and use it to run the service, coach the athlete and do what our privacy policy and the membership waiver describe. Use of photos and video of athletes is covered by the waiver.
Our content
The APEX name and logo, the website, the portal, and our training plans, workouts and other materials belong to Alpha Peak Technologies LLC or the people who license them to us. You may use them for your own or your athlete’s training with APEX. Please don’t copy, sell or publish them without our permission.
Other services
The service relies on others: Google for sign-in, Stripe for payments, and Cloudflare for hosting and email. If you also join a video call, group chat or training app with us, that service has its own terms. We aren’t responsible for services we don’t run.
Privacy
Our Privacy Policy explains what we collect and how we use and protect it.
Changes to the service
We keep improving the service, so features may change. We try to keep it available, but it may sometimes be unavailable, for example during maintenance.
Ending your use
You can stop using the service at any time. To close your account, ask from the portal’s Account page (Help and privacy) or email us; cancel any running membership first. To delete one athlete’s profile instead, use Delete profile at the end of their Profile in the portal. We may suspend or close an account that breaks these terms or puts others at risk, and we’ll tell you why unless the law or someone’s safety prevents it. A membership that ends is handled as its renewal terms describe. The sections on what you share with us, our content, disclaimers, liability and governing law continue to apply afterwards.
Disclaimers
We work hard to make the service accurate and reliable, but we provide it “as is” and “as available.” As far as the law allows, we don’t promise that it will always be available, error-free or suited to a particular purpose, or that training will produce particular results.
Limits on liability
As far as the law allows, APEX isn’t liable for indirect, incidental, special or consequential losses, such as lost data or lost profits, arising from your use of the service, and our total liability for any claim about the service is limited to the amount you paid APEX in the 12 months before the claim. Nothing in these terms limits liability that can’t be limited by law, or any right you have as a consumer that can’t be waived.
If a claim arises from misuse
If someone makes a claim against APEX because you broke these terms or misused the service, you agree to cover the reasonable costs that result, as far as the law allows.
Governing law
These terms are governed by the laws of the State of Utah, USA. If we have a disagreement, let’s first try to sort it out: email us. Otherwise, it will be resolved in the state or federal courts in Utah, except that either of us may use small claims court where it qualifies.
Changes to these terms
When we change these terms, we update the date at the top. We’ll email portal members about any important change before it applies. If you keep using the service after a change applies, the new terms apply to you.
If part of these terms can’t be enforced, the rest still applies.
